DMCA Takedown Policy

CopyFlag respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for handling copyright infringement claims under the Digital Millennium Copyright Act (DMCA).

Reporting Copyright Infringement

If you believe that content available through CopyFlag infringes your copyright, you may submit a DMCA takedown notice. To be effective, your notice must include:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the infringing material and its location on CopyFlag
  4. Your contact information (name, address, phone, email)
  5. A statement that you have a good faith belief the use is not authorized
  6. A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the removed content and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake
  4. Your name, address, and phone number
  5. Consent to the jurisdiction of federal court in your district

Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. We reserve the right to terminate accounts that we determine, in our sole discretion, are repeatedly infringing the rights of others.

False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability. Before submitting a notice, please ensure you have a good faith belief that the use is actually infringing.

Processing Time

We will respond to valid DMCA takedown notices promptly and in accordance with applicable law. Typically, we will process valid notices within 1-3 business days. Counter-notifications will be processed in accordance with DMCA requirements, which may take up to 10-14 business days.
